⚠️ IMPORTANT — PLEASE READ CAREFULLY
By downloading, installing, or using DTAQ Tactical, you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, do not download, install, or use the application. This is a legally binding agreement.
This End User License Agreement ("Agreement" or "Terms") is a legal contract between you ("User," "you," or "your") and Salah Eldin Alqinawi, DBA DTAQ Tactical ("Company," "we," "us," or "our"), governing your use of the DTAQ Tactical mobile application ("App" or "Application") and all related services, features, content, and functionality.
You acknowledge that this Agreement is between you andDTAQ only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. DTAQ, not Apple, is solely responsible for the App, the content thereof, maintenance, support services, and warranty, and for addressing any claims relating thereto (e.g., product liability, legal compliance, or intellectual property infringement).
By creating an account, accessing, or using the App, you represent that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (incorporated herein by reference), and all applicable laws and regulations. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least eighteen (18) years of age to use this App. By using DTAQ Tactical, you represent and warrant that you meet this age requirement. In jurisdictions where the legal age for firearm ownership or handling is higher than 18, you must meet that jurisdiction's legal age requirement.
You represent that you have the legal capacity to enter into this Agreement and are not barred from using the App under any applicable law.
The App is intended for use by individuals who can lawfully possess firearms in their jurisdiction. It is your sole responsibility to ensure that your use of the App complies with all applicable local, state, national, and international laws.
Subject to your compliance with these Terms, DTAQ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on Apple-branded products that you own or control, solely for your personal, non-commercial purposes.
The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
You agree NOT to:
All rights not expressly granted to you are reserved by DTAQ. This Agreement does not grant you any rights to use DTAQ's trademarks, logos, domain names, or other brand features.
Certain features of the App, including Cloud Vault synchronization, require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. DTAQ will not be liable for any loss or damage arising from your failure to protect your account.
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions, abuse promotions, or for any other purpose is strictly prohibited and may result in termination of all associated accounts.
DTAQ Tactical offers a "Pro" subscription tier that provides access to premium features. Subscription details, including pricing and features, are displayed within the App prior to purchase.
All subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same rate unless you change your subscription settings in your App Store account settings.
All purchases and billing are processed exclusively through Apple. Refund requests must be submitted directly to Apple in accordance with their refund policies. DTAQdoes not process payments or refunds directly.
If you reinstall the App or switch to a new device, you can restore your previous purchases using the "Restore Purchases" feature available in the App settings, provided you are signed in with the same Apple ID used for the original purchase.
We reserve the right to change subscription prices at any time. Price changes will not affect active subscriptions until the next renewal period. You will be notified of any price changes prior to your next billing date.
You retain ownership of all data, information, photos, and content you create or upload to the App ("User Content"). By using the App, you grant DTAQ a limited license to store, process, and display your User Content solely for the purpose of providing the App's services to you.
You are solely responsible for your User Content and represent that you have all necessary rights to such content. You agree not to upload, store, or share any content that is illegal, infringes on third-party rights, or violates these Terms.
You may export your data at any time using the Manual Export feature, which provides your data in a portable .zip format. This allows you to maintain a backup or transfer your data elsewhere.
You may delete your account and all associated cloud data at any time using the "Delete Account" feature in the App settings. Upon deletion, your cloud-stored data will be permanently removed from our servers within 30 days. Local data on your device will remain until you uninstall the App.
You agree not to engage in any of the following prohibited activities:
⚠️ CRITICAL SAFETY NOTICE
DTAQ Tactical IS A DATA MANAGEMENT AND LOGGING TOOL ONLY. It is NOT a substitute for proper firearms safety training, education, professional instruction, or sound judgment. Firearms are inherently dangerous and can cause serious injury or death if handled improperly.
BY USING THIS APP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
We do not guarantee the accuracy, completeness, or reliability of any data, statistics, calculations, ballistics information, split times, or other information displayed in the App. Users should independently verify all data and should NEVER rely on App data for life-safety decisions, legal compliance, or any situation where inaccurate information could result in harm, injury, legal liability, or property damage.
Nothing in the App constitutes professional advice regarding firearms, ammunition, gunsmithing, ballistics, legal compliance, or any related matter. Always consult qualified professionals (certified instructors, licensed gunsmiths, attorneys, etc.) for matters requiring professional expertise.
You are solely responsible for ensuring that your possession, storage, and documentation of firearms, ammunition, and accessories complies with all applicable federal, state, local, and international laws. Laws vary significantly by jurisdiction, and it is YOUR responsibility to know and comply with the laws that apply to you. DTAQ does not provide legal advice and makes no representations about the legality of any user's activities.
OPEN BETA NOTICE
DTAQ Tactical is currently in Open Beta. The App is under active development, and you may experience bugs, errors, data loss, or interruptions in service.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.DTAQ DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not guarantee any specific results from using the App. Performance statistics, analytics, and other features are provided for informational purposes only and may not reflect actual real-world performance.
The App integrates with third-party services (Supabase, RevenueCat, Apple, Google). We do not control these services and disclaim any responsibility for their availability, accuracy, or performance.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be DTAQ's sole responsibility.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DTAQ, ITS OWNER, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER DTAQ WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL DTAQ'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO DTAQ FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Without limiting the foregoing, DTAQ shall not be liable for:
You agree to indemnify, defend, and hold harmless DTAQ, Salah Eldin Alqinawi, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
The App, including all content, features, functionality, software, text, displays, images, video, audio, design, and the selection and arrangement thereof, are owned by DTAQ, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
DTAQ, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim related to the App. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such intellectual property infringement claim.
If you provide any feedback, suggestions, or ideas regarding the App ("Feedback"), you grant DTAQ a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute such Feedback for any purpose without compensation to you.
You may terminate this Agreement at any time by deleting your account and uninstalling the App from all your devices. Termination does not entitle you to any refund of subscription fees already paid.
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
Upon termination, your license to use the App immediately ceases. We may delete your account data in accordance with our data retention policies. Sections that by their nature should survive termination shall survive, including but not limited to: ownership, warranty disclaimers, indemnification, and limitation of liability.
DTAQ is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

You represent and warrant that:
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
Before initiating any formal dispute resolution proceeding, you agree to first contact us at dtaqapp@gmail.com and attempt to resolve the dispute informally for at least thirty (30) days.
If we cannot resolve the dispute informally, you and DTAQ agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the App shall be resolved by binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.
YOU AND DTAQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and DTAQ agree otherwise, the arbitrator may not consolidate more than one person's claims.
You may opt out of the arbitration agreement by sending written notice to dtaqapp@gmail.comwithin thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
This Agreement and any dispute arising out of or related to the Agreement or the App shall be governed by and construed in accordance with the laws of the State of California,United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in California, and you consent to the personal jurisdiction of such courts.
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and DTAQ regarding the App and supersedes all prior agreements and understandings.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
No waiver of any term or condition of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
You may not assign or transfer this Agreement or your rights hereunder without our prior written consent. We may assign this Agreement without restriction.
DTAQ shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemic, government actions, or failures of third-party services.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.
